how can a player signed in 2002 be signed illegal all these time with no one complain, its the system

Ricardo Rocha played the whole season in 2003 and 04, only in Portugal, when all the teams, players, fans, should be pulling for Porto against Monaco another story brakes thru.
I blame Fifa and the European federation for not putting a investigation long time ago, just a month ago the President of the Liga was arrested on 13 counts, including some of his assistants.

O Benfica está em risco de perder na secretaria a Taça de Portugal e o segundo lugar da Superliga conquistados esta época, devido a alegadas irregularidades na inscrição do defesa Ricardo Rocha.


A notícia foi avançada há momentos pela SIC, dando conta do facto de «Ricardo Rocha ter passado a época mal inscrito». Segundo pode ler-se no site do canal televisivo de Carnaxide, em causa estará a irregularidade do contrato inicialmente assinado pelo jogador, por ocasião da sua transferência do Sp. Braga para o clube da Luz, negociada na altura dos ingressos de Tiago e Armando – também provenientes do emblema minhoto – no Benfica, embora o Ricardo Rocha somente tenha rumado a Lisboa no final dessa temporada.

E o problema parece estar precisamente no contrato assinado pelo jogador a 15 de Janeiro de 2002 (reconhecido notarialmente no dia 18 do mesmo mês), que deveria ser válido com efeitos a partir da temporada 2002/03. Só que, conforme avança a SIC, Ricardo Rocha terá sido mal inscrito «perante o regulamento da Liga de clubes no seu artigo 32.º», na medida em que o futebolista «só poderia assinar contrato a partir de 1 de Abril».

Confirmando-se este cenário, Ricardo Rocha tem actuado no Benfica com uma inscrição ilegal, situação que poderá agora prejudicar desportivamente o emblema da águia. Isto porque, tendo em conta que os resultados da Liga são homologados 30 dias depois de se efectuarem, o Benfica ainda poderá perder os pontos averbados nos encontros com Sporting e União de Leiria (para a Superliga), para além do triunfo na final da Taça de Portugal, ante o FC Porto.

Confrontado com esta notícia, Luís Filipe Vieira relativizou a questão, remetendo para a Liga de clubes quaisquer informações suplementares sobre o assunto.

The first to be blamed should be Liga De Clubes. How can they allow this confusion to remain for so long? Second blame Benfica's board for not being serious enough and make such stupid mistakes. Anyway, it would be ridiculous to repeat the Cup final or to put Sporting in 2nd. Big mess, incompetence by both sides, solution: just register the player right and leave the rest as it is.

yeah benfica won the cup let them have it. plus some sort of fine so the club pay attention to this stuff in the future. Classic benfica though

Cunha Leal the temporary President of the Liga, a Benfica fan said, nothing to worry about, the newcasters at SIC over reacted, but in my opinion LFV the president of Benfica had the ball's to go out on live TV and turn the fire off.

O director-executivo da Liga de Clubes, Cunha Leal, considera «não existir fundamento para tanta polémica» com a alegada inscrição irregular de Ricardo Rocha, adiantando mesmo que qualquer lei respeitante a este «caso» terá sempre de ser integrada com o restante regulamento.


Isto porque Cunha Leal defende que a lei que alegadamente não foi respeitada aquando da inscrição de Ricardo Rocha «visa não permitir a celebração de contratos em determinada data de jogadores que estão ligados a outros sem o consentimento das partes envolvidas», algo que não aconteceu no caso de Ricardo Rocha, que se transferiu para o Benfica em acordo com o Sporting de Braga.

Desta forma, e através de quatro documentos que apresentou e que considera fundamentais para qualquer análise à situação (a entrada do contrato na Liga; o recibo emitido da taxa de licenciamento; o ofício circular a divulgar a recepção do contrato do jogador; e o documento da FPF a confirmar a sua inscrição), Cunha Leal considera não haver fundamentos para tanta polémica, dado que – conforme considerou - se trata de uma «irregularidade diminuta».

«Se os juristas confirmarem irregularidade de ter sido feito um contrato com a assinatura anterior a 1 de Abril, penso que essa irregularidade é suprível dada a sua homologação pela FPF. E, como não viola nenhum principio que se visa defender com a lei, a natureza da irregularidade é diminuta e portanto claramente sanável pela homologação. Caso contrário, quem recebeu o contrato teria obrigação de fazer alguma participação, algo que não aconteceu», rematou.

PDC called Cunha Leal when he find out via Sic, the acquisitations about Ricardo Rocha transfer, by saying in no way Porto would with file a complain.
he reply by saying the cups are to be won in the field of play and not in somebody's offices.
