That's true but there are exceptional circumstances this year round, noone got kicked out of the CL last year.
For me it would make sense for the second placed Bulgarian team to get the slot (Levski Sofia) to get the spot, since it's that country's allocated spot, and that's still a possible solution.
But UEFA have the decision to make... What I don't understand is how come Milan would get this slot but Benfica would get the slot with Porto getting disqualified, since it seems like double standards (along with kicking Porto out)

The onoly reason why Milan would get that slot is because they are the number ranked team in UEFA but they didn't get it anyway. Levski Sofia has been allowed to enter the preliminary rounds and good luck to them. I wouldn' want Milan getting into the C.L via that route

If this is the case then, just like Porto, they would be instantly kicked out under UEFA’s zero tolerance policy regarding such matters.
Their place would then be offered to Rapid Bucarest. However, there are reports that Rapid do not want to play in the Champions League, and neither are Dinamo, who finished fourth. In this case, Milan would be given the place as UEFA’s highest ranked team not already participating in the competition.
UEFA would have no choice but to award the place to the Rossoneri if Rapid snub their chance, a fact that will delight Milan fans worldwide, after it looked like the Italian giants had thrown away their Champions League prospects for next season.
The Rossoneri failed to qualify for the competition after finishing fifth in Serie A, following a less than vintage campiagn by their high standards.
The club now has the chance to jump straightback into the driving seat as they look to use UEFA's rule book to wriggle their way back into the European big time.

It's not the right way to get back into the C.L, but if the other teams don't want to play there is nothing Milan can do I guess. If they get to the C.L this will only encourage Galliani even more in saying there is no problem with the squad, no matter how ridiculous this may be.

I hope they get it. Lets face it, with all the money in the Premiership, we need the likes of Milan to even the playing field.

Milan will have to settle for the UEFA Cup as expected. Failure to qualify for the Champions League was down to Milan’s own downfall following a less than perfect campaign.
