Default Man united to pay back Mikel fee??

Manchester United may be forced to cough up the fee Chelsea paid for John Obi Mikel last summer.
The Mirror says the Blues were on alert last night to push for a multi-million pound cash-back payment from Manchester United after Morgan Andersen, the man behind John Obi Mikel's move to Old Trafford faced charges of forging his contract.

tribalfootball.com - Man Utd may be forced to repay Obi Mikel fee to Chelsea

I hope its not true, that would be embarresing!

Given the bizarre nature of the Mikel saga would something like this really surprise anyone though?

It's not the agent it's the Lyn Director, the Agent Shittu just ignored it,thoose two being bad guys not Mikel., if you wanna read all the articles I could post them in English.

Copied of a fellow Norgie on other site.

Quote:
A short summary of each article:

Unfortunate for Norwegian football

Ersnt Ravnaas in 'Norwegian Top Football' explains that it's unfortunate that the police now has charged Andersen, but emphasizes that there's a difference between getting charged for something and actually convicted.

Institute of Journalism criticises Morgan

Andersen is only willing to give interviews to the TV station of his new club Fredrikstad. The interview itself was described as meaningless and containing no critical questions.

Lyn could lose Mikel money

If former Lyn director Morgan Andersen has forged John Obi Mikel's signature, then Lyn has to pay back the £4M they got for him when they sold the Nigerian to Chelsea. That's the opinion of law professor Viggo Hagstrøm at University of Oslo, who specialises in contract law. Forged contracts are rare in Norway, but it should be easy to obtain technical evidence. However, if Mikel or Shittu should demand money back from Lyn, the football player would probably have to leave his current employer.

The Norwegian FA are looking into what their own laws and regulations are in a case like this. They refuse comment at the moment, but it's indicated that the club will be made responsible and that the Norwegian FA won't seperate between the actions of a club and that of an individual within that club.

Morgan Andersen: It doesn't surprise me

Former Lyn Director Morgan Andersen says that he's looking forward to getting all angles of the case presented in court. It will be up to the attorney-general to go through the documents from the police and decide whether or not there will be a trial. There are two aspects of the case, the first is that Andersen is claimed to have forged one of the contracts in the Mikel case, the other is that Andersen has wrongly accused Shittu of doing something criminal.

Lyn chairman Sveinung Lunde says that it's very disappointing that a Lyn director is supposed to have broken Norwegian law. "I take it for granted that a managing director, whoever it is, sticks to Norwegian law. Anything else would be outrageous."

Lyn chairman: I'm very, very disappointed

In 2005, the Lyn chairman said this about the contract forgery accusations: "It's a serious allegation, it's shocking, and I'd call it an act of desperation." Now he has changed his tune. "When we heard about the accusations seven months after (the contract forgery) should have happened, we considered it as part of a game. We listened to what Andersen had to say and found no reason to distrust him."

Morgan Andersen's lawyer, Cato Schiøtz, feels that the police to a large extent has trusted what John Shittu has explained about the situation. "It's obvious that in this case the police has believed John Shittu's statements and not my client's version".

Shittu "glad it's over"

Agent John Shittu expresses great joy of being exonerated in the case. "It's been a tough time for me. Thank God that it's now over", Shittu commented to TV 2. "Whatever you do in life, try to be careful. Do not try to destroy other human beings. That will come back to haunt you", he continues.

Even though the relationship between Shittu and Andersion has been difficult, and there have been accusations back and forth, neither Shittu or Mikel is considering private litigation against the FFK director.

But wouldn't Mikel have known about this and said something if he had mysteriously signed a contract he had no knowledge of?

Yep but if Lyn didn't own him when you signed him, then you do us our money back, Lyn owe you money back.

Basically, if Mikels contract was illegal with Lyn they had 100% no right to sell him to you. Thus what Anderson has been found guilty off.

Or it's something like

Lyn never sold Mikel to us since they didn't own him. We can sue them for sale by false pretence . Man U would also have to refund our 12M and demand its 4M back from Lyn.

It's gonna ramble on again .....

imo United shouldn't be forced to pay anything back, if anything it should all come from Lyn, £12M is a lot of money, and United took that into account when spending, if we didn't have that money we would perhaps have not made the same transfers or as expensive transfers so to take it away from us would be pretty unfair as we don't seem to have done anything wrong and the money has already been used.

So let's see in the ideal Chelski version ... Chelski keep Mikel and United would have to give the 12m back to Chelski. Since Chelski paid Lyn 4m for Mikel, they would have signed him for 4m effectively.

On the flip side, United are out 4m that they paid to Lyn originally. For the sake of argument we'll call the 12m a zero-sum amount, although I'm willing to bet that the 12m helped fund this summer deals.

So what do United do? They wind up filing suit against Lyn as a club and Andersen personally - probably to the tune of 12-15m overall.

What a complete friggin' mess ...
